Cases pending before Three–Judge Panels

The following cases will be decided by Three-Judge Panels, which have the same status as the former Tribunals of Commissioners. See Dorset Healthcare Trust v MH [2009] UKUT 4 (AAC) at paragraph 37 for current guidance.

The DWP failed to consider whether claimants transferring from IB to ESA were entitled to I-RESA, particularly if placed in the support group and so entitled to an enhanced disability premium within the applicable amount. The issue is whether arrears should now be paid only from 20.10,14, the date of MR’s decision in LH v SSWP (ESA) [2014] UKUT 480 (AAC); [2015] AACR 14, or from an earlier date.
